Terms and Conditions

By accessing and using the FlexySpot studio management platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

FlexySpot provides yoga, pilates, and fitness studio management services including:

• Class scheduling and booking management
• Participant registration and profile management
• Instructor management and assignment
• Membership plan administration
• Payment processing for classes and memberships
• Analytics and reporting tools
• Communication tools for studio-participant interaction

To access certain features of our service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

When booking classes through our platform:

• All bookings are subject to class availability
• Cancellations must be made at least 24 hours before class time
• Late cancellations may result in forfeiture of class credit
• No-shows will result in loss of class credit
• Refunds are processed according to the studio's refund policy
• Class schedules may change due to instructor availability or other circumstances

FlexySpot uses Stripe as its secure payment processor. By using our payment services, you agree that:

• All payments are processed securely via Stripe. FlexySpot does not store your payment card details on its servers.
• You authorize FlexySpot to charge your chosen payment method for the selected plan at the time of purchase and at each renewal period.
• All prices are displayed in RON (Romanian Leu) and include VAT where applicable.
• If a payment fails, we will notify you by email and attempt to retry the charge. Continued payment failure will result in suspension of your account until the payment is resolved.
• You will receive a fiscal receipt by email for each successful payment, in compliance with Romanian fiscal law.
• Disputed or fraudulent charges must be reported to us at support@flexyspot.ro before initiating a chargeback with your bank.

FlexySpot offers subscription plans that grant access to platform features for a recurring billing period:

• Subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled before the renewal date.
• You may cancel your subscription at any time from Account Settings > Subscription. Cancellation takes effect at the end of the current paid period — you retain access until then.
• No refunds are issued for the unused portion of a cancelled subscription period, unless required by applicable law.
• We reserve the right to change subscription prices. We will notify you by email at least 30 days before any price increase takes effect. Continued use of the service after the effective date constitutes acceptance of the new price.
• If you are on a free trial, you will not be charged during the trial period. The trial converts automatically to a paid subscription at the end of the trial unless you cancel before the trial end date.
• FlexySpot reserves the right to suspend or terminate access to the service if payment cannot be collected after reasonable retry attempts.

Under EU Directive 2011/83/EU and Romanian Law OUG 34/2014, consumers have the right to withdraw from a digital service contract within 14 calendar days of purchase, without giving reasons. However, by completing your purchase and expressly requesting that the service begin immediately, you acknowledge and agree that you waive your right of withdrawal once access to the paid service has commenced. If you have purchased a subscription but have not yet accessed any paid features, you may contact us at support@flexyspot.ro within 14 days of purchase to exercise your right of withdrawal and receive a full refund.

Users agree not to:

• Use the service for any unlawful purpose
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any part of the service
• Transmit any harmful, offensive, or inappropriate content
• Violate any applicable local, state, national, or international law
• Impersonate any person or entity or misrepresent your affiliation

To the fullest extent permitted by law, FlexySpot and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will cease immediately.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

These Terms are governed by Romanian law. In the event of a dispute arising from or related to these Terms or the use of the service, we encourage you to first contact our support team at support@flexyspot.ro to seek an amicable resolution. If the dispute cannot be resolved through direct negotiation, you may refer it to ANPC (Autoritatea Națională pentru Protecția Consumatorilor, www.anpc.ro) or to the competent courts of Romania. For cross-border disputes within the EU, you may also use the European Commission Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
